Terms of Service
This Terms of Service Agreement (hereinafter, the "Agreement") governs the relationship between the Administration of the Shomla service (hereinafter, the "Administration") and any person using the service (hereinafter, the "User").
Using the website shomla.com (hereinafter, the "Service") constitutes the User's unconditional agreement to this Agreement. If you do not agree with these terms, you must immediately cease using the Service.
1. Age Restrictions (Strictly 18+)
1.1. The Service is intended exclusively for individuals who are at least 18 years of age (or the age of majority in the User's jurisdiction, if it exceeds 18 years). 1.2. By registering with the Service, the User confirms that they meet the minimum age requirement. 1.3. The Administration reserves the right to request age verification at any time and to suspend the account if a violation of this clause is detected.
2. Registration and Authorization
2.1. Access to the Service's features is provided after registration via email or third-party authorization services (e.g., Google). 2.2. The User agrees to the collection, storage, and processing of their email address and basic profile information obtained from authorization services, solely for the purpose of maintaining and securing the account. 2.3. The User is personally responsible for the security of their account login credentials.
3. Rules of Conduct and User Content
3.1. The Service provides a platform for random voice communication between Users. The Administration does not pre-moderate audio streams and is not responsible for the words, opinions, or actions of the Users. 3.2. The User is strictly prohibited from:
- Using the Service to spread threats, insults, or calls for violence, extremism, terrorism, or self-harm.
- Broadcasting or discussing sexually explicit materials involving minors, as well as any other illegal materials.
- Using the Service for fraudulent purposes or advertising illegal services (including the sale of prohibited substances).
- Recording, storing, publishing, or otherwise distributing voice conversations with other Users without their explicit prior consent.
- Collecting personal data of other Users (doxxing). 3.3. In the event of a rule violation, the Administration reserves the right to block or terminate the User's account without prior notice, explanation, or the possibility of restoration.
4. Advertising and Third-Party Integrations
4.1. The Service is provided free of charge. To support the operation of the Service, the Administration has the right to display advertising materials, integrations, and ad blocks from third-party advertising networks (including, but not limited to, Google, Yandex, etc.). 4.2. The User is informed and agrees that third-party advertising networks may use cookies, web beacons, and collect anonymized data (such as IP address and browser type) to display targeted advertising. 4.3. The Administration is not responsible for the content of advertising materials or the quality of goods/services advertised by third parties.
5. Disclaimer of Warranties
5.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Administration does not guarantee that the Service will meet the User's specific requirements, or that it will be provided uninterrupted, quickly, securely, or without errors. 5.2. The Administration does not guarantee the adequacy, safety, or politeness of interlocutors with whom the User may be randomly connected. The User uses the Service at their own risk.
6. Limitation of Liability
6.1. To the maximum extent permitted by applicable law, the Administration shall not be liable for any direct, indirect, incidental, special, or consequential damages, including loss of profit, moral damage, or reputational harm arising from the use or inability to use the Service. 6.2. The Administration is not responsible for unauthorized access to Users' communications by third parties (e.g., hacker attacks).
7. Changes to the Terms
7.1. The Administration reserves the right to unilaterally change or update the terms of this Agreement at any time. 7.2. The new version takes effect immediately upon its publication on the website. Continued use of the Service constitutes your acceptance of the updated terms.
8. Governing Law
8.1. This Agreement is governed by the laws of the Administration's location. All disputes are subject to resolution through negotiations, and if an agreement cannot be reached, in the competent court at the location of the Administration.
